A rhode island lease agreement, and what the Residential Landlord and Tenant Act settles

Rhode Island adopted the uniform model as the Residential Landlord and Tenant Act at Chapter 34-18 of the General Laws. Because it is a full adoption, most of what a lease needs is already decided and the document's job is to agree the commercial terms without contradicting the act. The parts that still need care are the deposit sequence and the list of terms an agreement may not contain.

The act limits the agreement

Chapter 34-18 sets duties for both sides and restricts agreements that waive them, including attempts to have a tenant give up rights or agree in advance to pay the landlord's legal costs. Those clauses are common in templates written for other markets and their presence weakens a document rather than strengthening it. Check a form against the act's list before it is used more than once.

Deposits and the return period

The act caps the deposit by reference to rent, and requires it to be returned with an itemised written statement of deductions within a period after the tenancy ends and the tenant provides a forwarding address. Two events start that clock, so record both dates rather than diarising from the move-out alone.

Notice, entry and non-payment

Notice to end a periodic tenancy, notice before entry and the non-payment sequence are all set by the act, and the figures are Rhode Island's rather than the generic ones in a national form. Put each into the lease and keep a model notice beside it so that the right period is used under time pressure.

What is still yours to agree

Rent and its due date, term, utilities, pets, parking and maintenance allocation, within the act. Beyond the document, the process: a dated inventory with photographs, numbered receipts, a ledger that reconciles, and the same inspection at both ends of the tenancy.
